Is it malpractice in the state of Colorado if a psychician istant misrepresents by going by dr.?

In a medical setting even if they have a doctorate if a patient is in need of serious medical care wouldn't it be malpractice to misrepresent themselves as a medical doctor. Giving advice as if it were the advice of a legally full fledged medical doctor hampering the ability of the recovery of the patient.
